  1. Recitals and Acceptance of the General Terms and Conditions

These General Terms and Conditions of Sale (hereinafter “General Terms and Conditions”) govern the offer and sale of products by Azienda Agricola Casagrande di Lucrezia Calagna through the website www.agricasagrande.it (hereinafter “Site”).
The User, upon registration, is required to fully accept the General Terms and Conditions in order to use the service.
Azienda Agricola Casagrande di Lucrezia Calagna reserves the right to modify these General Terms and Conditions at any time, in whole or in part, by publishing a new version on the Site. Continued use of the Site by the User after publication constitutes unreserved acceptance of the changes.

  1. Parties and Scope of Application

These General Terms and Conditions of Sale govern the distance selling of wines and related products by Azienda Agricola Casagrande di Lucrezia Calagna (hereinafter the “Seller”), with registered office at Via R. The product offering refers to the alcoholic food category (wine products). The Products offered for sale on the Site are only those advertised in the dedicated section (“Shop”).
The purchase of products is permitted exclusively to adults (18 years of age or older). The courier may request identification upon delivery. The Customer guarantees that the person present at the time of collection is of legal age.

  1. Site Registration

The Site is intended exclusively for Users who are 18 years of age or older. Access to the sales service offered on the Site is subject to registration.
Registration is free. The Customer must register by providing, truthfully and completely, all the information requested in the relevant registration form and fully accepting the privacy policy and these general terms and conditions. The Customer undertakes not to disclose his/her credentials, even temporarily, to third parties and to maintain them with due care, diligence, and confidentiality under his/her own responsibility. They constitute the sole means of identifying the Customer and validating his/her access to the offers. The Customer is therefore informed that all acts performed using said credentials will be attributed to him/her and will be binding on him/her. It is understood that under no circumstances can the Seller be held liable in the event of loss, disclosure, theft, or unauthorized use by third parties, for any reason, of User login credentials.
Registration is required to purchase products and to access summary information relating to the Customer’s activities on the site (also referred to as the “Account”). Partial registration on the Site (hereinafter also “Partial Registration”) is also permitted, by entering only the Customer’s email address for newsletter subscription. If a Customer who has completed Partial Registration wishes to then purchase Products on the Site, it will be necessary to complete the mandatory fields required to complete the purchase before checkout.
The Customer may update and/or modify, or request deletion of the information provided during Registration at any time. However, in the event of a cancellation request, the Seller may temporarily retain such information, in whole or in part, for the sole purpose of processing any purchases made and/or completing accounting and tax procedures.

The Seller reserves the right to suspend or cancel the Customer’s account at any time and without notice if it believes that:
– the Customer has violated the Agreement
– access to or use of the Service could cause harm to Azienda Agricola Casagrande di Lucrezia Calagna, other Users, or third parties

The Seller may modify the duration of an offer at any time and at its sole discretion, without prejudice to the Seller’s decision to process orders placed during the validity of a given offer.
In some cases, an item may become available after purchase. In these cases, if the conditions are met, the Seller will notify the Customer within 72 business hours and refund the amount. Any partial orders (some products available and others not) will be handled separately, and refunds or replacements for missing products will be communicated within 72 business hours.

The products on the Site are intended for personal use. Consequently, the Customer warrants that he or she is acting as an end consumer and has no intention of reselling, directly or indirectly, the products purchased on the Site and/or by telephone for commercial purposes.

The Seller reserves the right to cancel the order received if the Customer, in order to circumvent the purchase limits indicated in the terms and conditions of sale:
a) uses a false email address with the same shipping address as another registered user;
b) enters a billing address identical to an address already used by another registered user. In any case, the Seller reserves the right to temporarily suspend the sale of certain wines if it detects order anomalies, such as a high number of purchases of certain wines in certain areas.

  1. Order and Contract Conclusion
  • Product images are for illustrative purposes only and do not constitute a contractual element. The catalog may indicate product availability subject to quantity and/or time limits.
  • The Customer’s submission of an order constitutes an offer to purchase.
  • The contract is concluded exclusively upon the Seller’s sending of the acceptance notice (order confirmation).
  • Product availability indicated on the website is purely indicative and not binding. Actual availability is confirmed only upon sending the order confirmation. In the event of unavailability, the Customer will be promptly informed and refunded: any partial orders (some products available and others not) will be handled separately, and the refund or replacement of the missing products will be communicated within 72 business hours.
  1. Prices, Taxes, and Excise Duties
  • Prices published on the website are expressed in euros and include VAT.
  • Any excise duties required by applicable law, duties, customs fees, or import charges applied in the destination country are the responsibility of the Customer.
  • Ad valorem duties applicable for certain destinations (including the United States and other non-EU countries) remain the responsibility of the Customer and, for the United States, will be calculated during checkout.
  • For shipments to Canada and Australia, customs clearance is the responsibility of the Customer, who must appoint a customs broker and comply with the requirements of the competent authorities.
  • Shipping costs are indicated separately before completing the order.

9. Purchase Procedure and Payment Methods

    Each order submitted constitutes an offer to purchase the products in question. Order fulfillment is subject to product availability and the discretionary acceptance of the same by Azienda Agricola Casagrande di Lucrezia Calagna. In any case, the company reserves the right to cancel orders and refund the amounts paid.

    The Seller cannot be held responsible for delivery errors due to inaccuracies or incompleteness in completing the purchase order by the Customer, for any damage to the products after delivery to the carrier, or for delivery delays attributable to the carrier. The Customer is responsible for the accuracy of the information provided for shipping purposes. Any additional costs resulting from address errors or failed deliveries attributable to the Customer will be borne by the Customer.

    The Seller uses patented and approved packaging, designed to guarantee product integrity. In any case, upon delivery of the goods, the Customer is required to verify that the packaging is intact, undamaged, or otherwise altered, including the sealing materials (adhesive tape or strapping), and that no liquid has leaked. Any damage to the packaging and/or product must be immediately reported by the Customer, placing a written reservation for inspection (and specifying the reason for the reservation, e.g., “Holey packaging,” “Crushed packaging,” etc.) on the courier’s delivery note. Once this document is signed, the Customer may no longer make any complaints regarding the characteristics of the goods delivered. Any problems regarding the physical integrity, correspondence, or completeness of the products received must be reported within 3 days of delivery by sending an email to: [email protected].
    In the notification, the Customer must provide a description of the defect found, indicate the product, the serial order number issued at the time of purchase, and the identification details of the invoice issued by the seller for the purchased products.
    In the event of non-delivery of the goods within the indicated timeframe, the Customer is required to notify the Seller, who will verify the status of the shipment and any anomalies with the courier. Following a shipping issue (for example, a package lost or destroyed during transport), the Seller will either resend the product, subject to stock availability, or issue a full refund for the order.

    During periods of high temperatures, the Customer acknowledges that transport may involve the risk of overheating of the products, which will not be attributable to the Seller. The Seller is not liable for any alterations resulting from extreme weather conditions beyond its control.

    1. Right of Withdrawal

    When purchasing products on the Website, the buyer has the right to withdraw from the contract within 14 (fourteen) days from the date of receipt of the products, returning the delivered goods to the Seller intact and without any alterations. The right of withdrawal does not apply to products delivered sealed that have been opened by the Customer. The right of withdrawal may only be exercised for intact, unopened, and undamaged products. Notice of withdrawal must be sent by email to [email protected] within 14 days of the delivery date and must contain:
    a) the Customer’s declaration of intent to exercise the right of withdrawal pursuant to and for the purposes of Article 54 of Legislative Decree No. 21/2014;
    b) an indication of the products for which the Customer intends to exercise the right of withdrawal;
    c) the order number issued at the time of purchase;
    d) the identification details of the invoice issued by the seller for the purchased products.
    The buyer who has exercised the right of withdrawal must return the goods intact and unaltered within 14 days from the date of notification of withdrawal. Opened bottles or bottles with tampered seals will not be refunded, as the right of withdrawal applies only if the bottles have not been opened and the original seal has not been broken.
    The cost of returning the goods is the responsibility of the Customer. The goods must be shipped to Azienda Agricola Casagrande di Lucrezia Calagna, Strada Comunale delle Masse 63/1 loc. The Customer is responsible for packaging the goods they intend to return and therefore undertakes to take the necessary precautions to safeguard the integrity of the product(s) and protect them from any damage and/or alteration.

Without prejudice to the right to verify the above, the Seller will credit the withdrawing party with the amount paid for the purchase of the product(s) within a maximum of thirty days from the date on which it became aware of the exercise of the right of withdrawal.

    In any case, the amount paid will not be credited before:
    a) The Seller has received the shipment of the product(s);
    b) The Seller has verified the integrity of the product(s).
    The clauses regarding the exercise of the right of withdrawal, as well as the related consequences and exceptions, apply exclusively to Customers who qualify as consumers, i.e., Customers acting for purposes outside of their business or professional activity.

    1. Product Warranty and Conformity

    The Customer is also aware that the images used on the offers may sometimes be merely indicative of the product and may not always accurately represent the delivered product. The Seller will be directly responsible for the conformity of the products. The Seller guarantees that the delivered products correspond to those indicated in the relevant product descriptions.
    In the event of non-compliant products, specifically any cork defects, the Customer must report this within 48 hours of opening the bottle to Azienda Agricola Casagrande di Lucrezia Calagna, via email at [email protected]. The bottle must be stored full (with at least 70% of the wine) and with its original cork. Any photographic evidence requested must also be provided.
    The Seller reserves the right to verify the defect by requesting the Customer to send the bottle(s) back and propose an appropriate remedy (replacement or refund) once the verification procedure has been completed.
    The Seller is not responsible for damage resulting from improper storage by the Customer after delivery.
    Except in cases of willful misconduct or gross negligence, the Seller’s liability is limited to the value of the goods purchased.

    1. Promotions, discount vouchers, and coupons

    Promotional initiatives, discount codes, and any vouchers are governed by specific conditions listed on the website or on partner websites (duration, scope, limitations, combinability).
    The Seller may issue discount codes (hereinafter also “Coupons”) that the Customer can use when purchasing products.     The Seller owns all rights to the graphic and conceptual content of the Site, its distinctive signs displayed therein, as well as any names, symbols, and images used to identify the Products on the site. Reproduction, even partial, of the content and graphics of the Site, as well as the distinctive signs displayed therein, is therefore prohibited.
    All content on the site—text, images, trademarks, logos, and multimedia materials—is protected by applicable copyright legislation. Any unauthorized reproduction is prohibited.

    1. Privacy and Protection of Personal Data

    Personal data is collected and processed for the purpose of fulfilling Customer requests. The Seller guarantees its users that it will operate in compliance with the regulations regarding the processing of personal data, governed by the Privacy Code pursuant to Legislative Decree No. 196/2003. The privacy policy is to be considered an integral and essential part of these General Conditions and is accessible in the Privacy section of the Website.     1. Applicable Law and Jurisdiction

    These General Terms and Conditions will be governed in all respects by Italian law. For any dispute concerning the interpretation, execution, and/or termination of the contract between the Customer and Azienda Agricola Casagrande di Lucrezia Calagna, the Parties acknowledge that the Court of the Customer’s place of residence or domicile will have jurisdiction, if the Customer is considered a “consumer” under applicable laws.
